These general conditions of use govern the contractual relationship between the Oriastral website ( hereinafter referred to as “Oriastral”) and the users of its services (hereinafter referred to as “user”).

User

The use of Oriastral’s services is reserved to persons having the legal majority in force in their country as well as the legal capacity to contract and use the services of the Oriastral site. The user is informed that these terms and conditions may be modified at any time without prior notice or information.

Conclusion and execution of the contract

Access to and use of Oriastral online astrology services implies the prior and unconditional acceptance of these terms and conditions. These terms and conditions constitute a contract between the user and Oriastral. If the user does not wish to accept all or part of these terms and conditions, he/she is asked to renounce all use of the Oriastral site and services.

Services offered

Oriastral offers its users the possibility to contact “experts” offering astrology services by email, audio or video. Oriastral also allows user members to post opinions and comments on the different astrologers previously consulted, and this via their “member” account.

Oriastral cannot be held responsible for the service provided by an expert, except in the event of Oriastral’s failure to meet one of its obligations. Subject to this limitation, Oriastral assumes no responsibility for the quality of the services offered by the experts, the comments and evaluations provided by the users, or the professional qualifications of the experts.

Oriastral cannot be held responsible if a user suffers any prejudice whatsoever as a result of a consultation provided by an expert, except in the event of Oriastral’s failure to meet one of its obligations.

Designation of services

Oriastral provides users with an astrology service by email, audio or video in the field of the divinatory arts. Each user will be able to evaluate a consultation and submit a message about their expert’s performance. Oriastral allows these evaluations in order to increase the quality of the consultations provided by each expert. The set of services provided by Oriastral cannot be considered definitive or exhaustive.

Access to services

Oriastral consultation services are not free of charge. These services are based on the payment of a service by the user by credit card or other means of payment. The costs generated by the use of this service are entirely at the charge of the user. Oriastral undertakes to provide an optimal service to allow a permanent accessibility to the different consultation accesses (24/7) of the services on the site, subject to necessary maintenance interventions or breakdowns specific to the Internet network. Oriastral cannot be held responsible if the user’s internet network is defective, even temporarily, and does not allow the user to connect or communicate in good conditions.

Registration

Consultations with payment by credit card as well as expert evaluations are reserved for members registered on Oriastral.

They have the possibility of registering as Oriastral members, any person having acquired the majority in force in their country of residence and enjoying their full and complete capacity of discernment, and whose legislation of the country of residence has not made any opposition. The user is solely responsible for ensuring that the legislation of his country does not prohibit online astrology activities and the professional practice of the divinatory arts in general.

The registered user is solely responsible for the information provided and for keeping it up to date. In case of change he will have to proceed via his Oriastral account and as soon as possible, to the modification of the information communicated at the time of his registration. The user assumes full responsibility for the data stipulated in his account.

The user is solely responsible for the quality and confidentiality of his personal password, as well as for any activity generated by his personal code and Oriastral account, such as payments. The user agrees to immediately notify Oriastral of any unauthorized use of the password or account or any other breach of security via the contact address.

The user will ensure that his account is closed at the end of each session.

In the event of fraudulent use of the user’s personal password or means of payment, Oriastral reserves the right to suspend or terminate the user’s account and to deny, immediately and for the future, access to all or part of the user’s account.

Termination

Oriastral reserves the right to delete a member’s account at any time without prior notice. Oriastral does not have to justify its decision and no compensation can be claimed by a member or a user of the services offered via the site.

Access to the services of the Oriastral site may be permanently denied to any user who has provided false or erroneous information when registering, who has interacted with other users of Oriastral’s services or who has violated these terms and conditions.

The user will not be able to have several accounts under the same or different identities. Oriastral reserves the right to suspend or terminate the user’s account(s) and to refuse, immediately and for the future, access to all or part of the Oriastral site. The user may terminate his account at any time via the “delete my account” link on the user account home page. The user account will be deleted according to the delay mentioned in the privacy policy.

Consultations

The user undertakes to contact the astrology experts present on the Oriastral site only in order to benefit from the services offered by the experts within the framework of the services of the site.

The user should not try under any pretext to persuade the experts present on the Oriastral website to provide services of an illicit nature or contrary to the Oriastral code of ethics. The user furthermore refrains from inciting experts to provide him/her with services outside the Oriastral site.

The user is not authorized to record the content of telephone exchanges between him and the experts via the Oriastral site, unless he has obtained prior express authorization from Oriastral.

Consultation by prepaid account (credit card, Paypal, bank transfer)

Written consultation:

The tariff of the consultation in writing or by email is indicated on oriastral.com before the setting in relation with the expert. The expert has five working days to respond. Beyond this time limit, the consultation may be reimbursed only in the event that the expert has not respected this response time limit and at the express request of the user. Once the user has sent his email, he cannot renounce to the consultation or even access a refund of the consultation. Once the time limit is exceeded, the user remains free to restart his consultation via his client interface.

Oriastral’s Warranties and Liabilities

The user is informed that Oriastral does not guarantee the user’s satisfaction with the services of the experts. More generally, Oriastral cannot be held to guarantee results with regard to the services offered and/or used by a user via an expert. Under no circumstances can the content of the consultations constitute legal, medical or psychological advice. Oriastral provides users with several experts specialized in divinatory arts, whose qualifications and skills are previously evaluated, tested or validated.

Dispute with an expert

In the event of a motivated request from a user and if it is necessary for the user to assert claims against an expert, Oriastral reserves the right to provide the user with the identity and contact details of the expert. In this case, the user accepts that the expert will be informed and that his identity and his own contact details will also be transmitted to him. The same principles apply in the case of a request from an expert. Oriastral will decide at its sole discretion and without having to give any justification if it transmits information or not, any legal obligation being reserved.

Unless required by law or court order, Oriastral cannot be obliged to transmit this information. Oriastral transmits the information that has been communicated to it, but it does not incur any liability in the event that this information is inaccurate or false, except in the event of a breach of one of its obligations.

Commitments of the user

The user undertakes to use Oriastral services and to contact experts only if he has sufficient financial resources, is not in debt or experiencing difficulties and is not undergoing medical treatment related to depression or a similar disorder. In addition, he must have reached the legal age of majority according to the law of his country and at least 18 years of age.

The user agrees not to resell or use for commercial purposes the services provided by Oriastral or one of its experts without the prior written consent of Oriastral.
The user assumes sole and full responsibility for any messages, comments or ratings made on the Oriastral site, as well as communications with experts. He is also solely responsible for his choices and actions.

The user agrees not to use the Oriastral site and services for illegal purposes in particular:

– not to transmit messages contrary to public order and morality, defamatory remarks or elements that infringe the privacy of third parties;

– not to transmit messages, elements or information that could harm the rights of the Oriastral site or the rights of third parties;

– not to interfere with the proper functioning in the use of the services provided by Oriastral to other users or infringe on the property rights of Oriastral or those of a third party;

– to inform Oriastral of any violation of which the user may be aware; not to access or attempt to access in an illicit manner other networks or computer systems connected to the Oriastral site;

– not to use the Oriastral site to harm the latter through the transmission of viruses or other programs, harmful software.

The user undertakes not to use several accounts under the same identity to benefit from promotional offers and/or gift vouchers.

In the event that the user has several accounts under the same or different identities to benefit from promotional offers or gift vouchers, Oriastral reserves the right to delete the promotional offer or gift voucher without prior notice to the user. Similarly, Oriastral may suspend or terminate the account(s) of the latter and refuse access to all or part of the Oriastral site for a limited or unlimited period.

Expert assessment

The scoring or expert evaluation service is a free service but can only be used after consultation via a prepaid account. Each rating deposited via the user’s account is done by depositing a rating (from 1 to 5) imaged by stars as well as a personalized message. Each evaluation is moderated by the Oriastral team before publication. Reviews containing abusive, xenophobic, defamatory or otherwise offensive messages will be automatically deleted. The evaluation service does not allow you to contact an expert and expect a response.

Private addresses, email addresses, internet addresses, telephone numbers and personal contact information are not allowed in the notices or comments.

The rating and comments are only intended to rate or thank the performance of the experts. Only one rating is allowed per consultation. Oriastral is in no way responsible for the veracity of the comments transmitted by users and declines all responsibility.

By commenting on the experts, users give Oriastral the right to reproduce and adapt the commentary free of charge, without limitations of time, place and support. Users are informed that once submitted they can no longer modify or delete it.

The user is solely and uniquely responsible for what is said in his comment or private message. Each user giving a comment or private message is personally responsible for it and undertakes to take all necessary measures to assist and compensate Oriastral in the event of claims by third parties due to a comment or private message, for example in the case of a claim for damages.

A notice must be filed within 21 days of the consultation. After this period, the notice can still be sent by private message to the expert.

Validation of customer reviews:
Comments posted on the Oriastral website are subject to a prior moderation (before publication) by the editorial team. The messages will not be altered, they will be published in their entirety or deleted if they are deemed not to comply with the charter. This publication or not is made within 14 days so that the moderating service can verify the content of the opinions by submitting them in parallel to the expert for the latter to exercise his right of reply.

Private message

Oriastral users have the possibility to send a private message to an expert, for example to prepare a future consultation, to propose a date and time of consultation or to ask the expert to indicate his availability on his schedule. The expert will receive the message with the member’s nickname, and possibly his photo or document.

Private messages are moderated by the Oriastral team before transmission to the expert. A valid email address is required to validate messages. Private addresses, internet addresses, telephone numbers as well as personal contact information are not allowed in private messages.

Commitment and limitations of services

Oriastral strives to offer a serious online astrology service accessible 7 days a week, 24 hours a day, but it is not responsible for the quality or availability of the internet service and in particular for cuts or other disturbances due to internet providers. Consequently, no compensation can be claimed by a user in this respect.

Abuse

We invite you to report possible abuse of an expert by using the “report abuse” option on each expert’s page.

Withdrawal

By clicking, the user having validated the registration and payment conditions, unreservedly approves the general terms and conditions of use and, in doing so, accepts that the provision of service begins as soon as the price has been paid and thus expressly renounces his right of withdrawal, in accordance with article L.221-25 of the French Consumer Code.

In accordance with article L.221-5 of the French Consumer Code, the user of an Oriastral service has, when he is a consumer within the meaning of the applicable regulations, the possibility to retract without reason within fourteen (14) days from the conclusion of the contract. In this case, it may use a form as mentioned at the end of these Terms of Use.

However, in order to allow the user of Oriastral’s services to contact “advisers” or “experts” without waiting for the expiry of the above-mentioned period if he/she so wishes, the user expressly accepts, in application of the first paragraph of article L.221-25 of the French Consumer Code, that the provision of services begins as soon as the price of the service is paid by the user, and thus refuses the benefit of the right of retraction for any service fully executed before the end of the above-mentioned retraction period (article L.221-28 of the French Consumer Code).

In accordance with article L.221-25 of the French Consumer Code, the user who has exercised his right to withdraw from a contract for the provision of services whose performance has begun at his express request before the end of the withdrawal period shall pay the professional an amount corresponding to the service provided up to the communication of his decision to withdraw; this amount is proportionate to the total price of the service agreed in the contract.

Claims

Mediation of consumer disputes

In case of complaint, the user should first contact Oriastral. In case of failure of the claim to Oriastral, the consumer can submit the dispute opposing Oriastral to a mediator who will try to bring the parties together in order to reach an amicable solution. In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Oriastral adheres to the following mediator: INAD – Institut Nationale des Arts Divinatoires

Dispute Resolution Platform

In accordance with Article 14 of Regulation 524/2013, the European Commission has set up an online dispute resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union.

Severability of clauses

If any provision of these terms and conditions is held to be invalid, void or unenforceable, such provision (or the part thereof that renders it invalid, void or unenforceable) shall be disregarded, without affecting the validity and enforceability of the remaining provisions.

Data protection and intellectual property

In accordance with the new regulation relating to the protection of personal data (RGPD N°2016/679) the company owner of oriastral.com may collect personal data essential to the provision of certain services to users of its sites.

The conditions and modalities of treatment of personal data collected by the company owner of oriastral.com during the use of the sites and/or application are governed by the provisions of the Privacy Policy.

Application and modification of the terms of use

Any access and/or use of the Oriastral sites implies the acceptance and respect of all the present general conditions of use as well as the Privacy Policy.

These terms and conditions are subject to change at any time and without notice by Oriastral. By continuing to access and/or use the Oriastral sites after the modification of the general terms and conditions, the user confirms acceptance of the new version of the general terms and conditions.
